What Is a Sewer Lateral?

A sewer lateral is the privately owned pipe that connects your home’s plumbing to the public sewer main. Property owners are responsible for maintaining the full length of the line, even when it runs beneath sidewalks or streets.

City of Santa Cruz: Inspection Within the Public Right-of-Way

If the property is located within the City of Santa Cruz, a sewer lateral inspection is required at the point of sale. This applies to any residential property connected to the city sewer system.

Here’s what’s required:

  • A licensed plumber must complete a video inspection of the sewer lateral
  • The inspection must cover only the portion of the pipe within the public right-of-way
  • The video must be submitted to the City’s Public Works Department for review
  • If defects are found, repairs must be completed before close unless the buyer formally agrees to take responsibility

Properties may be exempt if the entire lateral has been replaced within the past 20 years with proper permits and inspections.

Santa Cruz County: Full Lateral Inspection Required

In unincorporated areas of Santa Cruz County, the requirements are more comprehensive. If the property is connected to a sewer system managed by a county sanitation district, the seller must:

  • Complete a video inspection of the entire sewer lateral, from the structure all the way to the main
  • Submit the report to the county for review
  • Complete any required repairs or officially transfer the responsibility to the buyer prior to closing
  • Use the County’s official Transfer of Responsibility form if repairs will be completed after escrow

You can confirm whether a property is in a sanitation district on the Santa Cruz County Public Works website.

Common Reasons Sewer Laterals Fail Inspection

  • Root intrusion
  • Cracked, offset, or sagging joints
  • Standing water caused by bellies in the line
  • Non-compliant materials like Orangeburg or deteriorated cast iron

Even minor issues can result in required repairs or full replacement, depending on the jurisdiction.

Inspection Costs and Repair Expectations

  • Video inspections typically cost between $200 and $500
  • Repairs can range from a few thousand dollars to $10,000 or more
  • If the repair involves digging in the street or sidewalk, expect additional permits and fees for traffic control and paving

Escrow and Repair Responsibility

Both the City of Santa Cruz and Santa Cruz County allow sellers to transfer repair responsibility to the buyer, as long as the correct procedures are followed.

City of Santa Cruz

  • Sellers can use the City’s Transfer of Responsibility to Repair form
  • The buyer must agree in writing and complete the work within 90 days of closing

Santa Cruz County (Unincorporated)

  • Sellers can use the County’s Transfer of Responsibility form if completed prior to closing
  • The buyer must apply for a repair permit within 30 days of close
  • Repairs must be completed within 90 days, unless an extension is granted by the county

Without a valid transfer form, all repairs must be completed before escrow can close.
