These regulations help protect groundwater, reduce surprise costs during escrow, and ensure the system is functioning safely. What Changed in 2023?

As of July 1, 2023, Santa Cruz County requires a septic system inspection and pumping report for any real estate sale involving an onsite wastewater treatment system. This applies to homes with septic tanks in both unincorporated and incorporated areas of the county. The update is part of the county’s effort to reduce environmental risk and improve wastewater system oversight at the point of sale.

Inspection Validity: How Long Is It Good For?

The septic inspection and pumping report is valid for 12 months prior to the close of escrow. This updated timeframe was confirmed in the County’s OWTS Disclosure Advisory, which clarified that the previous six-month limits were extended to reduce redundant inspections and pumping. The timeline applies countywide as part of Santa Cruz County Code Section 7.38.216.

What the Inspection Involves

  • The septic tank must be pumped unless it was already pumped within the last six months and proper documentation is provided.
  • A flow test using at least 250 gallons of water is required to confirm that the system is functioning correctly.
  • The inspection must be completed by a licensed liquid waste hauler, and the report submitted to the County’s Environmental Health Division using the appropriate forms.

If Repairs Are Needed

If the system fails the inspection or shows signs of structural damage, the seller is generally expected to complete the necessary repairs before the sale is finalized. However, buyers and sellers can agree to transfer responsibility for repairs. In that case:

  • A Transfer of Responsibility form must be signed by both parties.
  • The buyer must apply for a repair permit within 30 days of the closing date.
  • All repairs must be completed within 90 days of closing unless an extension is formally approved by the county.

Regular Maintenance Expectations

Septic systems typically require pumping every 3 to 5 years, depending on system size, household usage, and whether a garbage disposal is used. Regular maintenance is essential for avoiding costly failures down the road. Some unincorporated areas of Santa Cruz County may have more specific maintenance requirements based on past inspection results or environmental sensitivity.

Septic vs Sewer: Why It Matters

Homes in rural or unincorporated areas of Santa Cruz County are more likely to rely on septic systems. These systems work well with proper care, but they can limit options when it comes to expanding a home or adding new plumbing fixtures. Key considerations include:

  • Adding bedrooms or bathrooms may trigger a required septic upgrade or a larger leach field.
  • Some lots have limited soil capacity or slope constraints that make upgrades more complicated or expensive.
  • Proximity to creeks or wells may require advanced treatment systems or engineering solutions.

In contrast, homes on public sewer systems generally have more flexibility when it comes to remodeling, though sewer lateral ordinances may still come into play.

The seller is responsible for obtaining the septic inspection and pumping report before closing. If repairs are required, the cost can be negotiated during escrow. Buyers will want to review the inspection report closely and request available maintenance records to understand the system’s condition and history.
